Were you or someone you love hurt in an accident involving a DoorDash driver? Alternatively, were you driving for DoorDash when you were in an accident and injured? For as convenient as food delivery services can be, for as many opportunities as they can afford drivers, they can lead to dangerous accidents. If you were injured in an accident due to someone else’s recklessness and negligence, then you deserve to be compensated for it. That’s exactly what Belal Hamideh, DoorDash accident lawyer, can help with. Hablamos Espanol.

DoorDash Insurance Explained

According to DoorDash, “DoorDash provides third-party auto liability insurance for Dashers (DoorDash drivers) involved in accidents while in the ‘Delivery Service’ Period. Per (the DoorDash) Independent Contractor Agreement, Dashers must also maintain primary auto insurance with minimum limits as applicable by local insurance laws.”

Now, DoorDash defines the “Delivery Service Period” as beginning “when a Dasher accepts a delivery request on the DoorDash platform until the order is marked as delivered, unassigned, or canceled. If Dashers are online but have not accepted a delivery quest, their auto insurance is primary.”

Additionally, for this coverage to apply, “Dashers are considered liable for damages or injuries to another party while in the ‘Delivery Service’ Period” and if “a claim has been submitted to the Dasher’s auto policy, and they have denied the claim and provided (the Dasher) with a coverage denial letter.”

Only if both of those conditions are met does the DoorDash coverage apply.

Furthermore, as they stick in a “Note” at the bottom of that page: “Damages sustained to a Dasher’s vehicle are their responsibility and should be addressed by their auto insurance carrier.”

In summary, DoorDash insurance only applies if the driver (“Dasher”) is in the “Delivery Service” period. If they aren’t, then their insurance applies. Furthermore, while DoorDash does offer some insurance, it doesn’t provide any for the Dasher’s vehicle.

A DoorDash Driver Crashed Into Me

If you were hurt in an accident involving a DoorDash driver, the first order of business is to remove yourself from harm’s way. To the extent that you are able without putting yourself at further risk, leave the center of the road, get away from any and all hazards that could make this dangerous situation worse.

When you can (and as much as you can) check yourself or others involved for injuries.

As soon as you can, call the authorities. Do this even if it doesn’t seem like you or others involved were injured. The truth is that, unfortunately, sometimes the worst of injuries aren’t fully discovered until long after the accident. The sooner you receive professional medical care, the sooner you can begin recovering from your injuries.

You want the police to arrive as well, even if the accident seems minor. If nothing else, they will file a police report, which will be a boon during your case.

Exchange information with the other driver. Do so in a manner which is as cordial as it is polite. But, do not do anything, anything that could be construed as you saying “sorry” or admitting fault, regardless of the circumstances.

If you can do so safely, collect evidence. If there are witnesses, get their information, too. Take pictures and even video if possible of damage to the vehicles, damage to the environment, injuries that you’ve suffered, and so forth. So much of that will have been fixed by the time your case gets going, that you want to be able to document it as soon as you can so as to give yourself the best chance at success.

Once you’ve done all of the above, contact us for a free case evaluation. We’ll take your case from there, doing everything in our power to make sure that you recover all of the damages you should.

I’m a DoorDash Driver Who Was in an Accident

You should perform all of the actions mentioned in the above section. Just as with anyone else who was injured in a vehicular accident in  California, if the other party acted in a negligent and/or reckless manner, causing the accident which led to your injury, you could be eligible for compensation.

Damages from DoorDash Accidents in California

The damages you can claim for your DoorDash accident are determined by the particulars of your case. For example, you may be eligible for economic as well as noneconomic damages. Economic damages are those that can pay for bills that came about because you were involved in the accident.

These could be the medical bills that you’re now responsible for, such as visits to the doctor, transportation to get to and from the doctor, any medications to pay for your injuries, any rehabilitation that you now have to go through, and so forth.

Noneconomic damages, on the other hand, cover that which you’ve had to deal with as a result of the injury. This could be your pain, your suffering, how much your quality of life has diminished, the consortium you may have lost, and so forth.

When you contact us for a free case evaluation, Belal will go over your case and, drawing upon his extensive experience, let you know exactly which damages you’re eligible for. Then, he’ll do everything in his power to ensure that you get them.
