If you find yourself in a collision while riding with UBER, your immediate action should be to ensure your safety.
Better still, if you are in good health, ensure everyone else is safe. If anyone is injured, don’t hesitate to call 911.
Even if there are no apparent injuries, seeking medical attention is pivotal as shock might be hiding them. It’s also crucial to file a police report when officers arrive at the scene.
Documenting evidence is equally important; gather the Uber driver’s details and those of others involved in the accident, including any witnesses. If safe, take photographs of the scene and any injuries you might have sustained. Note down the exact location of the accident for future reference.
Lastly, get professional legal advice; you might be deserving of compensation, and an experienced attorney will guide you through the process.
The above is true whether you were a UBER passenger, UBER driver, or hit by an UBER. Suing UBER is practically impossible, but you can receive compensation for your injuries.
Belal Hamideh, an UBER accident attorney with experience, can let you know exactly what your case is worth as well as how he can help you to receive it.
How an UBER Accident Attorney Can Help
Were you involved in an accident involving Uber, or another rideshare service? Whether you were a passenger, driver, or pedestrian, you may be entitled to compensation. Rideshare services are popular and convenient, a safe way to return home after a night out. Yet, every rideshare driver, despite their experience, can meet with an accident. If you’ve sustained injuries from a rideshare accident, assistance from an Uber accident attorney could be crucial.
If you were injured as an Uber passenger or hit by an Uber driver, remember, your injuries were not your choice. The aftermath could include dealing with medical bills, loss of income due to inability to work, prolonged rehabilitation, and other setbacks. Belal Hamideh Law boasts years of successful experience with such cases. We utilize this experience to secure the full compensation you are entitled to.
What should you do if you’re part of an Uber Accident as a Passenger?
Ensure safety first. Your driver should move the vehicle out of danger; remind them if necessary. If it’s safe and you’re capable, inspect yourself and others for injuries.
Summon emergency services. In case of serious injuries, request an ambulance. Always seek medical attention, visible injuries or not, as shock may mask the injuries. Make sure to file a police report once they arrive.
Collect evidence, if feasible. Gather the Uber driver’s details: name, license, insurance. Collect the same from others involved, including eyewitnesses. If it’s safe, take photographs of the damaged vehicles, the location, and any injuries. Document the accident location accurately.
Consult an attorney. You could be eligible for compensation. A seasoned attorney can ensure you get it.
What if an Uber Driver Hit Me?
Your rights remain the same as those of an injured Uber passenger. Your safety is paramount. Follow the same procedures described above. Acquire the Uber driver’s information. Seek medical help promptly as some serious injuries manifest with time. Once you’re ready, contact an experienced attorney for help.
Injured while driving for Uber, what’s next?
Once you complete the same steps mentioned above and obtain the other driver’s details, reach out to a lawyer experienced in rideshare accident laws. This should be your first move if you were driving for Uber and got injured due to someone else’s fault. Uber does not prioritize their drivers’ interests, as the California Assembly Bill 5 clearly showed. Navigating these laws can be complex. Uber will exhaust all avenues to evade financial obligations. By securing a seasoned attorney, you place yourself in the best position for the compensation you deserve.
Grasping Uber’s Guidelines and Coverage Insurance
The policy limits of Uber for its drivers hinge entirely on whether the driver was “offline” (not logged in to the application) or in Period 1, 2, or 3.
Offline. Should an accident happen in this state, the driver’s personal car insurance would cover the damages since they were not logged into the Uber app during the accident.
Period 1. This period refers to the time when an Uber driver has logged into the Uber app but has yet to receive a ride request. In this period, insurance policy limits include $100,000 for bodily injury liability coverage per accident, $50,000 of bodily injury liability coverage per individual involved in an accident, and $30,000 of property damage liability coverage per accident.
Period 2 and Period 3. These refer to the time when a driver accepts a ride (Period 2), and when they pick up a passenger (Period 3). Uber provides $1 million in uninsured/underinsured motorist coverage as well as $1 million in commercial auto insurance for drivers in these periods. Notably, in Period 2, an additional $50,000 for bodily injury coverage is provided if the driver hasn’t yet received a ride request.
Remember: Uber has a track record of attempting to undercompensate accident victims, sometimes even denying liability. We will do everything within our power to prevent that from happening to you.
Can I File a Lawsuit Against Uber for My Accident?
Previously, victims of Uber accidents have tried to directly sue Uber when they were injured in accidents caused by reckless and/or negligent rideshare drivers. However, Uber typically claims that their drivers are independent contractors, not employees. But, with the passage of California’s Assembly Bill 5, this standpoint is now “up for debate.” The most effective action you can take is to contact an experienced accident attorney.
Deciding who is liable in Uber car accidents is akin to determining liability in other car accidents. If you were injured in a rideshare accident while the driver was logged into the app and the injury was primarily caused by the driver’s recklessness and/or negligence, it could be in your best interest to file a claim.
In California, the legal standard for negligence encompasses the following: if the defendant owed you a duty of care, if the defendant breached that duty out of negligence, and if the defendant’s negligence was the leading cause of your injuries. Negligence may manifest as driving while intoxicated, texting while driving, driving at excessive speeds, breaking traffic laws, or simply not concentrating. We have assisted many clients in situations similar to yours to prove that rideshare drivers were negligent and caused avoidable injuries.
What is the Value of an Uber Accident Claim in California?
The potential financial recovery in your accident case depends on various elements. Factors such as the intensity of your injuries, the impact on your ability to earn an income, the amount of pain and suffering endured, your recovery timeline and potential, and future medical requirements all come into play.
These constitute your “economic damages.” They are quantifiable. According to Californian law, you are entitled to claim compensation for both economic and non-economic damages following an accident. Economic damages can cover all medical expenses resulting from the accident, like ambulance costs, surgical procedures, rehabilitation services, and ongoing physical therapy.
You may also be eligible for economic damages for lost wages, should the accident prevent you from working. Indeed, you might even secure compensation for diminished earning capability, if the accident impairs your ability to perform your job as before.
Non-economic damages address non-tangible losses such as emotional duress, pain and suffering, changes in lifestyle due to the accident, forfeited recreational pursuits, emotional anguish, injuries leading to disability or physical hindrances (including lasting disfigurement), or even a decreased quality of life. We commit to fighting for our clients passionately to ensure they receive maximum compensation for their suffered consequences.
When Should I Lodge My Uber Claim?
In California, you have a two-year window from the date of your rideshare accident to present your claim. However, this timeframe reduces to six months if the accident involved a state/municipal/federal vehicle in any capacity. The sooner you consult with a lawyer, the quicker you can secure the compensation you’re entitled to.
