How Does Postmates Accident Insurance Work?
Postmates does offer excess auto insurance to its drivers. However, this does not replace the driver’s personal insurance. In fact, Postmates demands its drivers keep insurance equal to or greater than the minimum requirements for the state they’re driving in while working under Postmates.
As of this writing, Postmates provides one million in excess liability to third party claims. These are only used after everything has been used up in the driver’s personal auto insurance coverage.
Even then, Postmates only covers damages if the driver was on what’s called “Active Delivery.”
In this context, “Active Delivery” means that the driver has selected “accept” on Postmates and the customer hasn’t received their order yet. During that time period, Postmates will cover accident damages. They will not do so during any other time.
So, even if the driver is on the Postmates app but hasn’t accepted a delivery request, Postmates insurance will not come into play. This is just as if the driver is offline entirely, as any accident would then be on their insurance.
Postmates policy currently includes:
Up to $100,000 for accidental death benefit and survivors’ benefit, up to $1 million for accidental medical bills, and up to $500 weekly in on-demand service replacement earnings for both continuous total disability and temporary total disability, respectively.
As you can see, this entire situation can become very complicated quickly. Belal Hamideh and the team here have experience with these kinds of cases. Drawing upon our experience, we can parse the legalese and make sure that you receive the maximum compensation that you deserve.
I’ve Been in a Postmates Accident. What Should I Do?
The first step is always to move out of the way of further harm, as much as you’re able. This could mean getting out of the road, moving away from other hazards, and similar actions.
Check yourself and others for any injuries.
Contact the authorities. Hopefully, neither you nor anyone else involved in the accident was injured. However, if there’s even the slightest hint of injury, get medical assistance. The severity of a car accident injury may not be known for sometime after the accident. The sooner you’re examined by a medical professional, the better a position you’ll be in for lasting recovery.
The police can assist in multiple ways. For one, they will be able to provide a police report. This report can be greatly beneficial to your case.
Exchange information with the other driver(s). Name, contact information, insurance, and so forth. Stay calm, polite, nice, and cordial. Don’t apologize. Don’t say “I’m sorry” or anything that could be construed as such.
Document evidence (as long as you can do so safely). Take pictures of the accident. Take pictures of your injuries. Of special note: environmental damage. Skid marks can be removed, building damages can be repaired, fences that have been knocked down can be righted, etc. – collecting this evidence now can help your case.
Once you’ve done all of the above, reach out to us for a free case evaluation. From there, Belal can take your case, representing you as aggressively as possible.
I’m a Postmates Driver Who’s Been in an Accident. What Do I Do?
In short, do everything mentioned above. Just because you were driving for Postmates, that doesn’t make you ineligible for potential compensation from another driver’s actions. If they were operating their vehicle in a negligent, reckless manner in a way that led to your injury, you deserve compensation. We will bring a suit against all liable for your accident, so that you recover all of the damages you should.
Are There Damages I Can Claim for a Postmates Accident?
Absolutely. In a California car accident case, whether it involves Postmates or not, those who have been injured through others reckless and negligent actions can be eligible for economic as well as noneconomic damages.
These can cover costs that you may be facing on account of having been in the accident. If you were injured to the extent that you are now dealing with medical bills, bills for medication, for rehabilitation, physical therapy, and more, those could be covered. Additionally, if you’re unable to return to your job (or to return to your job in the same capacity) and thus have lost wages, you can recover compensation for those lost wages as well.
Too often, after having been in an accident, you could be going through all manner of pain and suffering, your quality of life could be diminished, you may have lost consortium, and so forth. We can help you to recover damages for all of that (and so much more) as well.
When Should I File for a Postmates Accident Case?
Essentially, you should file a claim as early as possible. In this state you have two years from the date of the accident to file a claim. While that may seem like a long period of time, it really isn’t. That’s particularly true when you’re dealing with an extensive recovery period, struggling to figure out what’s next, and so forth.
In some cases, you may actually have less than two years to file a case. The truth is that the earlier you reach out to an experienced Postmates accident lawyer, the better off you will most likely be.
